With a fiance visa, you will no doubt, be apart sitting in the US while your significant other has to sit and wait in his/her country. if the US citizen just marries the person in that person's country, they can sit and wait together for the spousal visa. The US is such a messed up place. I'm ashamed to say I was born in that messed up place. I've even talked to people who say they wouldn't fool with the fiance visa...it's too much trouble. I guess some folks don't mind being apart...but I do!

I even heard that once you file the fiance visa application, you are screwed and are saying hello to being apart. Your fiance can't even come to the US to visit you after you file that thing. My American friend was under the notion that her Korean fiance could come see her for Christmas after she just filed for the fiance visa. I bet he didn't go visit her either. She was also under the impression that they would have the fiance visa in 2 months...yeah right! I think they are in for a bad wake-up call.

With the K-1, you file two applications. With the K-3, you file three applications. More work, more possibility for error, and longer processing time. K-3s tend to be used by people who are already married and don't have a choice. For people who do have a choice (not married yet), most opt for the K-1. |

First of all, the wait times for both the K-1 and K-3 are almost the same. But the difference is that with the K-3 - you get married somewhere and then have to be apart AFTER your honeymoon. Bummer! But with the K-1, waiting is not so much a problem as you both have been doing this for quite some time. E-mailing each other and such. So when the K-1 comes, you go to the US, get married within 90 days of your arrival and live happily ever after! So what if you can't visit, the one in the US can visit anyways. But to each his own. |
