Illegal alien. It is a legal term. I use illegal immigrant most of the time, though. Guest worker isn't apt, however, because it assumes an invitation. A ton of them don't work, and the problem is as much in their being in our schools as in our jobs, so undocumented worker isn't apt, either.

Again gokart you know the most apt and legal term to be used in this case is " illegal alien." The term "illegal immigrant" was quickly developed by Americans as a replacement for illegal aliens, probably because we saw "aliens" as being from outer space or something and were trying to be politically correct, but the terms are used interchangeably. Furthermore, I think you know that the term "undocumented worker" is just a politically correct term developed to describe illegal aliens in hopes of "sanitizing" the political aspects of their presence inside the US by those that benefit from and support their presence. Guest workers are a totally different class of foreign visitor than illegal aliens in that they have been given temporary legal clearance to come into our country to do those (and this can be debated) "jobs Americans won't do"- such as migrant farm workers; of course, you are correct that many come on guest worker visas and over-stay their legal time allowance in the US and, thus, become illegal aliens, illegal immigrants, undocumented workers or any other term you want to use to classify them.

Illegal alien is the proper term, after they have been convicted in court for that crime. Prior to conviction they are suspected of being an undocumented worker or an undocumented alien.

There is a legitimate guest worker program (H and L Temporary Visas) so that doesn't apply at all.
