i'm trying to get residency in California, i've been living and working here for 5 months, but i wanna go out on vacation for a week to Texas (my hometown), so my question is, if i go out on vacation would that affect my attempt to get the residency in california? (you have to work and live in california for 366 days to get residency)

If you are under 18, not married or in the military, your residence is that of your parents. If you are over 18, and you are in California with the intent to remain permanently, you are already a resident. Residency is determined by where you intend to remain, and there is no length of time you have to be in the state before you are a resident. What you seem to be referencing is the 366 days OF residency required to pay resident tuition at a state university. This does not mean 366 consecutive days of presence in the state, but if you leave for any substantial length of time there could be a question whether you changed residence. One week should not affect your residence. Presence in the state for educational purposes is not itself going to show residence.
You do not have to have gone to a state high school to pay resident tuition. However, if you are under 24, you are going to have to prove not only residency, but also financial independence from your parents. |

To be a resident you have to be in a state more than 180 days in a year. There is no patrol monitoring the border.
By the way, for in state college tuition, you have to have gone to a California high school for three years. |
