Adjustment of status after marriage....how long can I wait?

If you get married to someone on a tourist visa,how long can you wait until after the marriage to file for adjustment of status? I heard that it can be for years after the marriage and that as long as someone is married to a u.s citizen its fine....any help??

I don't get it-- why would you want to wait? The tourist visa will expire, they will have to leave the country. If you wait a really long time CIS may think you don't have a real marriage. Most people want that status adjustment as soon as possible and someone who wants to put it off for a long time is going to look suspicious.
On the other hand there is no deadline for applying, you can apply any time.
(and no it is not fraudulent to get married on a tourist visa; you have to be willing to leave when the visa expires.) |

You should file as quickly as possible while still in a form of status. If done after status lapses, it becomes far more complicated and difficult.
If caught and detained, it would not help to file at that point. |

It might be fine, and it might not. If they start deportation proceedings before you file, it's too late. File as soon as possible, preferably before your tourist visa expires, or you will be taking a huge risk. |

Getting married on a tourist visa and applying for adjustment of status is called visa fraud. 5 years federal prison each with the alien deported and banned from the US for life!
