My little sister was adopted by our parents in Azores Lajes Air Force Base. Our father being military. WE moved all over world, She has worked in this country, paid taxes, has a SS card & # been maried ,has children and now at age 49 and appling for Pass Port is told she is not a US Citizen. She has been my little sister since she was 1yr old How can this be ?

Well, she may not be a citizen, but does she have permanent resident status should be your real concern for the moment. the regulations concerning foreign adoption have indeed changed. Now, when an American adopts a child and brings them into the US on an immigrant visa they become a citizen on entry, precisely because of problems like this. Military familes often travel on military flights and don't go through regular immigration controls as well, so maybe they never filed the proper immigration paperwork to begin with. In the past, lots of parents never bothered to do the paperwork for citizenship, and as a result, the kids never became US citizens. then, if they got into legal trouble later on, their green card status was revoked and they were deported. So, believe me, it could be worse. So, get an attorney, and check it out as soon as possible. |

She needs to consult with an expert in immigration law. This is because the laws have undergone many changes over the years. What's applicable today was not applicable 48 years ago when she was adopted.

Unfortunately, your parents must have failed to apply for her US citizenship when they adopted her. Their lapse means she is not a citizen and it is too late to do anything about it. Adoption did not automatically confer citizenship. As with birth to a US citizen while abroad, it is up to the parents to prove their child has a right to US citizenship and obtain that, or else apply for and obtain the child's immigration. There are quite a few people who think they are "citizens" but aren't because their parents failed to do what was necessary to protect their child. |
