i arrived in united states last march 28 2009 under CR1 visa. my husband just went back to iraq and i'm planning to go back to the phil until he comes back in sept. what are the consequences? can i return to the states using the same visa after 5 months of staying in the phil? i don't want to lose my permanent resident status. please help.

Yes, you can return to the Philippines.If you have been here since March,2009 you should have received your green card already.That will allow you to be out of the US for less than a year without the need for re-entry permit.However, if you don't have your green card yet, the I-551 stamp in your passport will suffice. |

You are allowed to be outside the U.S. for the entire period of time that your spouse is stationed overseas.
The spouse and children of a member of the U.S. Armed Forces, or a civilian employee of the U.S. Government returning from a foreign assignment are exempt many normal requirements for returning residents pursuant to 8 CFR 211.1(a). If a dependent is a conditional resident, and the period of conditional residence has expired, the alien should be admitted and advised to file Form I-751 within 90 days.
If is not your CR-1 visa that you can use, but you can use a green card (Form I-551), whether or not expired, because you are the spouse of military employee who is on overseas duty. You can be outisde the U.S. and return at the same time as your spouse or preceed him, or follow to join him within 4 months of his return to the United States |
