What do you mean by rights? Do you mean will it be entitled to Irish citizenship or do you mean other things like education, child benefit etc?

Regarding citizen, from January 2005, birth in the Republic of Ireland does not automatically entitle a person to citizenship. In order to become an Irish citizen at birth one or both parents must be Irish or British. If you are a foreign national living in the Republic of Ireland, you must be, legally, resident for 3 out of 4 years before the birth of the child (time spent in the Republic as a student or as asylum seeker does not count). In your case, unless your partner is Irish, it is unlikely your child will be an Irish citizen.

If you're worried about childcare, education, child benefit etc you should visit the welfare officer at your University. If you're not studying at University, speak to your GP or his nurse, ask them to put you in contact with the welfare officer for your area or contact the Department of Social & Family Affairs to find out what you're entitled to.

No it won't have the same rights as an Irish child since it won't have Irish citizenship. Under the provisions of the Irish Nationality and Citizenship Act 2004 children born of certain foreign national parents on or after 1 January 2005 are not automatically entitled to Irish citizenship.

It depends. Birth in Ireland does not result in automatic citizenship.

If your child is entitled to any other citizenship at birth, he is not entitled to Irish citizenship, unless his father is an Irish citizen or is entitled to Irish citizenship.

you make no mention of who the father is and what his nationality is.

do not think that by having a baby you get to stay, that door was closed years ago.

if you are no longer studying then you are in breach of your student visa and will be sent home right away.

student visas do not allow you to not study....


so sorry you child gets what rights you have as a non eu person
