If a Canadian goes to the US and marries an American, can the American now cross the border and live in Canada with his Canadian wife? What needs to be done to the American across the border for good without them thinking there is fraud?

The Canadian needs to sponsor the American for permanent residency. http://www.cic.gc.ca/english/immigrate/sponsor/spouse-apply-how.asp#step1 is the link to it but to clarify, there are 2 options to do this, inland and outland.
Inland, the husband states he is officially living in Canada and the application will be processed completely in Canada. He can request an open work permit with his file but it will not be issued until first stage approval in 6-7 months. Getting permanent residency will take 12-18 months. It's not advised to travel outside Canada while this is being processed.
Outland, the husband will pick the application for not living in Canada, he can still write on the forms that he is but request the file to be processed in the US. He can expect to get permanent residency in 5-10 months. If he gets called for an interview, it will be in the US.
Whichever they pick, they need to make sure to apply for a visit visa extension for him if he is still in Canada on a visit status that is about to expire. Also send a lot of data to immigration to support their relationship, photos of them together, emails and phone bills for when they were apart etc. The most common reason to get refused is that immigration doesn't believe it's a real marriage. |
