the way it stands now an employer would be shooting himself in the head by thinking he could get away with hiring a immigrant..however if the immigrant is legal to work in the united states he or she should have an equal chance at landing the job

i am very against illegal aliens, i DO NOT CARE HOW QUALIFIED they are, if they are illegal, they need to go thru the legal protocol, and quit taking money, and sending it back across the border. don't even get me started.if they want to work in the u.s. they need to become american citizens,and when they earn their money, they need to keep it, in the u.s. , to stimulate the economy.

No there is NO such law

Provided the resident has a LEGAL green card then the employer must choose the most qualified position with the best personality to fit in.

qualified and personality - BOTH count towards who gets the job.

If you are legal, you can try sueing, but if you are white and the other person was a minortity then you may lose the case.
however if you are a minority and the one they chose was white - the employer MAY be racist.

BUT you MUST have proof.

You cannot sue them for libel or slander as you have NOT lost your reputation.

The H1-B legislation kind of mentions it but there are law firms like Cohen & Grimsley that actually hold seminars on how to get around these laws.

It's up to the employer who he/she wants to hire, and that's the person he/she knows is best for the job. That person might be illegally here, but so many US companies, especially ones that specialize in landscape have come to rely on these hard working people. Some have tried hiring college students, and some have even stated that they would rather close shop, then to replace the illegal immigrants that helped them succeed. This is one of the many reasons why we should all push for AMNESTY.

One Triangle landscaping business has found immigrant workers indispensable

A decade ago, Louise hired illegal immigrants to work in her Triangle landscaping business because she could find no one else willing to dig and haul from sunup to sundown.

Now, she employs illegal immigrants because they are the best workers she has ever had. Because they have learned their trades during years on the job. Because she has worked beside some of them long enough to feel more like a mother than a boss.
