I was told a story about a person who said he was black on a civil service test to get extra points. When he went to the interview he was kicked out because he was clearly white. So it got me wondering. If his parents were traveling in Africa and gave birth to him there, could he say that he is African - which Americans call black? Could he legally check that he is black on the application?

What abotu Lisa Bonet from the Cosby show? She is white-skinned. I think everyone considers her to be black. If your parents are American citizens and give birth overseas, the child cannot become president because he/she was not born in the US.

Actually, your addition is not correct. You write that a child born to American citizens overseas cannot become president since he or she was not born in the US. However, the Constitution actually says, "No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President..."
Since a child born overseas to two US citizen parents acquires US citizenship at birth, that child is (probably) also eligible to be president. I say 'probably' because this has never been tested in court.
Further to your original query, if the person was born in an African coutnry that grants citizenship to anyone born within it, then the person might legitimately claim to be African, but 'African' is not the same as 'black'. Consider, for example, all the white farmers who have lived in various African countries for many generations: they also are African but are not black. |

No -- doesn't work. Even if born in Africa to US citizens, since he would have no right to citizenship in an African nation, and would not be of African descent/race/ethnicity, he could not get any preferences under affirmative action. |
