American citizen giving birth outside of USA, will my child be USA citizen?
|
Hello, I am American citizen who's pregnant and live aboard with my husband. I am planning to give birth to my child out side of US. I've been aboard for a year now, am recently pregnant, and what i know if i go US now no insurance will cover for my baby's birth if i am already pregnant; and the expenses with out insurance are very high. I'd rather save that money for my child's school.
Where i live now giving birth costs a whole lot less! My "big" ultrasound was at the doctor's office and it cost $35. And, I go to an "expensive" private practice. Ultrasound in general runs around $40. Birthing in the hospital would cost me between $600 and $800. A c-section at the private hospital costs around $1700. And the level of care here is outstanding.
The problem is my husband is not a US citizen, and the county i live in don't give citizenship to children who's born here not that i even want it.. what u think i can do? if i go to the county where my husband from the baby would get a citizen from there after his father, but i want my child to be American citizen like me. What should i do in this situation? Additional Details they will allow that even if my husband isn't American?

Yes your child will be an American citizen, and probably also be a citizen in it's father's country - check the law to make sure it allows dual-citizenship. |

Yes. Don't worry. Children born to one citizen parent and one foreign national will obtain citizenship at birth if the citizen parent resided in the US for five years before the birth, with two of those years after the age of 14. The child does not need to take any special action to retain US citizenship. You should have your child, then register the birth with the US Consulate, just for the record.. |

The child will likely be a citizen. The procedure to follow is here:http://travel.state.gov/law/info/overseas/overseas_703.html |

This is very simple. US law states that if you are a US citizen who has lived in the USA for 5 years during your life, including 2 years after the age of 14, any child you have will be a US citizen because of birth to an American mother, wherever they are born. It won't be a "natural-born citizen" if born outside the USA but the only difference that makes is that it won't be able to run for President. This is about normal for most civilised countries - a parent who has a significant connection to the country of their citizenship will automatically pass that on to their child. Your baby might even have dual citizenship from birth depending on where your husband is from.
Edit - good point from previous answers. Get the birth registered at your local US Embassy as well as locally and that'll make it a lot easier for your child as a US citizen later on. |

Immediately after baby is born, you need to take the "long-form" birth certificate, hospital records, baby, photos, your proof of US citizenship to the nearest US consulate and file a report of birth to an American citizen while abroad, and get baby's US passport. Then you apply for a Social Security number. Be sure you do this promptly! Until you register, baby's rights are not really protected.
Your husband follows basically the same procedure at the nearest consulate for his country of citizenship and gets baby a passport for his country of citizenship.
Baby is a dual-national with rights to citizenship in each parent's country of citizenship. Get both passports! Protect baby's rights.
Keep those passports, original birth certificate, original Social Security card, original hospital records, etc, in a safe deposit box at a bank! Protect them CAREFULLY! These original docs are not replaceable - you can only get copies. All of these docs are valuable to thieves who sell them to illegal aliens, criminals, etc. Your baby needs these docs for the rest of his/her life so guard them CAREFULLY! This is extremely important and I cannot emphasize this enough. People are out to steal those docs so keep them in the bank safe deposit box except when you actually need to use them, then put them away again immediately. |

He will be an American. I was born in the Middle East to an American mother and English father, and currently hold dual citizenship. |

The child is an American. Sounds like you are in the middle east and I would say to pack up and get out of there before the baby is born and out of your control. |

In most cases yes. |

The link below will supply you with all the info you need to register your baby as an American - you do this at your nearest US Consulte or Embassy - worry ye not, it's all been done many thousands of times before. Only problem I can see is that your baby, American, not born in the USA means unable to run for the presidency - at least I think that's the rule.

Hello,
I am not sure if what you all discussed above applies to me as well...my husband is a naturalized American citizen, has lived there for 20 years. I am not, but I'm not sure that the child I carry will have American citizenship, as 10 years ago he returned to the country of origin and did not go back.
should I apply for the American citizenship for my child or it's not the case?
thanks! |
