ok, here is the scenario........
1.) i am a us citizen, was born and lived in the us all of my life, and have documentation to prove so
2.) acquired dual nationality in canada, became a canadian citizen, moved and is now residing in canada
3.) my wife is only canadian, married her in canada, she has never been to the us
4.) i had two twins at a hospital in canada, they have never been to the us
are my children us citizens? do they have dual citizenship at birth?

They should be citizens of Canada, I think you have to apply if you want them to have dual citizenship. |

I believe the law states if the children are born in a different country ( other than the US ) both parents have to be legal US citizens..
Otherwise, they would have to be born in the US, regardless of what citizenship their parents hold...
The laws might of changed, but this is what I was told when I was pregnant in the early 1990's... |

you are an amercan citizen, because of that, your children can have duel citizenship if wanted. Check with the consulate. |

Well let's see.. Did you have the babies or did your wife?? I think that will make a huge difference.
She is a Canadian.. sooooo last I checked she had them right? That would make them Canadian. |

no they are Canadian citizens. You have to be born in the US to be a citizen or get a pass. |

I'm guessing that the fact you became a Canadian citizen (in effect renouncing your US citizenship) means no, they are not. |

I am always amazed at the people who opt to answer questions like this when they do NOT have a clue what they are talking about! I am the same as you, born in the US, immigrated to Canada, acquired naturalized Canadian citizenship, so now have dual US/Canadian citizenships. I was told that my son, who was born in Canada, is also a US citizen, but I did not register his birth with the US when he was born. He can still get his papers, but he is 30 years old now and it will be more difficult, though he still says he plans on doing so.
As some people said here, what you need to do is go to your nearest US Embassy and register the birth of your children. While you're at it, you may as well apply for your US passport and put the children on it, too. Yes, this would be the easiest way and I wish I had done so for my son. While the US does not "recognize" dual citizenship, they also cannot take away your other citizenship and they can only take your US citizenship from you if you have ever done anything to "renounce" your US citizenship.
Anyways, bottom line, go register your children's births with the US Embassy asap. Congrats on your twins! |
