If we deny alien children the right to attend school, then the children of Americans living abroad could also be denied that right. The UN convention on the Rights of the Child, and Migrant Workers Rights and our bi-lateral international treaties provide that (although we may tax or charge a fee) we cannot deny that right. The Supreme Court has held as much and our tax law and treaties provide that persons physically present in the US for 183 days are US residents regardless of their immigration status.

Whether the children's parents are legal or illegal is irrelevant because the children had no choice in coming here and cannot leave on their own. Their presence is not voluntary and their rights under US and international law are not affected by their parents status.

On the other hand, I have processed out-of-status and undocumented foreign wives and children of drug-dealers for "voluntary removal," because their husbands were going to prison and they were "likely to become a public charge."

We need comprehensive immigration reform, and the federal government should address the issue of compensating local school districts, or giving them some say in the process.

Seriously not educate a child? No.

However those parents should not be here. And neither should those children. I am suggesting that we aggressively identify illegal aliens, arrest and deport.

And make significant strides in reducing the illegal population.

Amanda, I am assuming that you mean illegal children ? Then yes ma'am, I do seriously suggest that. I also suggest employers be held so severely accountable for employing illegals that they will not be here working at all while their children roam our streets...they will either be deported, legalized in some form...in a probational type of working visa (and then of course their children should be schooled here). I think that they deserve a basic education in their own country, yes. If they are legal well, in this one too. Illegals...no. Our education systems are taking a brutal beating and I am sick and tired of seeing deteriorating budgets, book shortages, overcrowded classes, increases in school violence and all the while, my taxes go up and up and up. Nobody ever suggested they should roam our streets either...you know?

the laws do need to be over-looked when it comes to this kind of thing. unfortunantly being the country that everyone wants to make a life in is becoming a burden on areas with immigrants. i agree that as children they should have the right to an education just as anyone else, but their families need to abide by certain rules and so forth. i don't know whats going on in our society these days with these kinds of things - but the reason why they are coming to america is because they are not getting even half to the same opportunities in their own country - and it's a sad thing to know! if america can't help children then what kind of country are we? i know we have so much going on trying to deal with our domestic education and the wars etc. If America could help or give guidance to those countries who need the better education - so that they can stay in their homelands...i think that would help a lot. Too bad a lot of their leaders don't agree..

Personally I have given up on criminals. I swore an oath to uphold the law but our hired help(elected politicians) are not doing their jobs and upholding the laws on the book. Then someone says that my tax money should go to educate the children of people who spit on my service to our country by the very fact they are here illegally. Do you have any idea just how angry this makes me? When I went to school it was a privilege not a right. Misbehavior, inattention, and failure to do your work could get a student thrown out on his ear. I had two major heart attacks last year and my heart now functions at only 36% an social security says that is not disabled enough for disability. I can not work and can not get the security my government promised me even though I paid 100% of what was required for 21 of 34 years. Why, because the are giving it as Social Security Suplimental Income to the wives and children of illegal aleins who are in jail for 20 years to life. (think I am lieing? My wife works at the Lea County Correctional Facility where 80% of the inmate population is hispanic and of that population half are illegal aleins. My wife as a case worker just verified the sentence of one illegal so his wife and kids could continue to recieve SSI.) Tell me again why we should educate the illigemate children of illegals.

I think the anti-humane people (what I think we should call the anti-immigration folks at this point) should realize the Supreme Court has spoken on this subject and ruled that services are Constitutionally required for children of immigrants regardless of their legal status.

Furthermore, beyond our Constitution, it appears the US is a signatory of several international agreements that require our government to provide services to the children of "aliens" residing in our nation like others have to do for our children.

What are YOUR solutions?? You ask a volatile question, support the OTHER side (meaning, NOT America or Americans), offer no solutions, and then get offended when people get upset.

Most Americans, rightly so, I might add, are thoroughly disgusted with the fact that we have tens of millions of illegal aliens in our country, with the numbers increasing all the time. It seems our government has been sitting on its butt with its thumbs where the sun "don't" shine for years now and we are FED UP!!!

We have many major issues, as does any large country, and other countries are pawning their problems (millions of them)off on us.

Most Americans want our borders secured, our laws enforced, and illegal aliens deported.

it is obvious that you don't have an over population of mexicans in your city. say in your daughters grade there were say 15 children of illegal mexicans in her class that do not speak English. do you want your school tax dollars spent educating these children. now don['t forget you will have to bring in special teachers to translate for them and or to teach them in spanish.

your child will not receive the attention from the teacher that she normally would reducing her over all education because of the children of illegal aliens in your daughters class room.

now, this may be fine with you personally but the average American citizen is sick and tired of the illegals demanding education, health care etc. out of our tax dollars.

before i end i would also like to mention while these illegals are working they are using the social security cards of citizens!!!!!!!!!!!!!! are you willing to put up your social security number so that they can work, use your credit and not pay taxes come the end of the year??? then when they RUIN your credit it will be your responsibility to FIX YOUR CREDIT THAT YOU DID NOT RUIN...... would you be so willing to have them here if that shoe was on your foot?????

they are driving illegally, no drivers license, no insurance.... they hit your car, guess what, you are responsible etc. etc. etc!!!

If ALL of them were sent back to their own countries we would not have the gang problems we now have with the illegals. Let them get educated/or not, in their own country and do the gang stuff there. They are now allowed in schools and the gangs and gang members are increasing in my area. I am tired of building more and more schools built for these illegals, who don't foot the bill for them.

Speaking as a non-American with plenty of American friends, it seems to me that the US has some horrendous social problems which could easily be solved with what, for the world's richest country, is a small amount of money. Some poor countries have better health services. Early intervention by social workers, decent housing, more police and better public education would reduce violent crime to something like European levels. Hurricane Katrina hit Cuba as well as Louisiana but it didn't kill anybody there because the government had an evacuation plan ready. Dogmatic dog-eat-dog capitalist doctrines cause immense misery in America. Even the very wealthy would be much better-off if they were heavily taxed to fund the public sector.

I think you have totally misunderstood where anti-illegals are coming from. My kids have to go to school with a great number of Hispanic kids that can't even speak English. These kids share classes with American children. Too much time is taken to teach them English & that is the reason American children's grades suffer. If the government stops the problem of anchor babies & took away the welfare state from illegal aliens, then they will "self" deport. They should also give huge fines to companies that hire these people illegally. I get sick of people throwing out the number 12-20 million illegal aliens being deported. 12-20 million can leave, just as easily as it was for them to come here...!!! Simple as that!!! The people that are pro-illegal should be made to foot the bill for these people to be here if that's what they want, but don't force American citizens that don't want them here to foot the bill. You want them here... You pick up the tab. Leave me & my money alone!!! I have no simpathy for criminals. They wouldn't have simpathy if I were to go to their countries & expect to be taken care of because I purposely had a baby in their country (don't forget... After going there illegally).

The laws that exist RIGHT NOW, today, the laws that have existed for decades are that it is a CRIME to enter the USA illegally, it is a CRIME to live in the USA if you are here illegally, it is a CRIME to work in the USA if you are here illegally etc...

Where on earth did you ever get the idea that illegal immigration is not a crime right now?

Illegal aliens are all criminals , right now, today, they were criminals last week, last year, and the year before, and the year before and the year before, and the decade before that and on and on, back generations.

I have mixed feeling about educating the illegal children of the illegals. It's true e that we can not afford to not educate them, being that they are here and unless we enforce our laws they will be here for the foreseeable future. Then again how much can we as tax payer have to pay to educate those that have no business being here, and the more we pay the more will come, and deny our own children in the progress. This also gives the parents of the children who are illegal, another signal that we know we are being taken for a ride, but have no way to separate educating their children from, letting them know that they are breaking our immigration laws, and need to go home.

Of course this is a recipe to disaster. Children that aren't educated are more likely for commit crimes. Every child deserves that basic right to go to school. And if you ask me anyone that disagree with that statement isn't thinking logically.

as a daughter of 2 immigrant i think that if the children where born her they have the same exact rights as any American they were born in this land and they have the right to breath,eat,live and get a good education here there is no need to take away there education. the children are going to school not there parents!..THANK YOU for supporting immigrant (i gave u a star) =)
