hi everybody
I really appreciate if somebody gives me a answer on my question.
I have a chronic hepatitis B, since a little girl. the country where I was born doesn't have any resources, any medications, anything that can help me. actually they make my situation worst because they are afraid of my disease, humiliating me, not accepting me like a human being. I am tired of that and I fill way happier and healthier here, in USA.
Am I aloud to ask for an Asylum?

You're ALLOWED to ask, but be prepared for a very difficult fight. If you have a credible fear of persecution based on being a victim of a disease, you are free to ask for asylum.
I think you would have a difficult time convincing an Immigration Judge that you have a well-founded fear of persecution based on at least one of five internationally recognized grounds:
Race, religion, nationality, membership in a particular social group, or political opinion.
If you believe that you have a strong argument that people with hepatitis B form a particular social group which is persecuted, perhaps you would be granted asylum. |

No, as Yak Rider says you'd have to show that somehow this is related to one of the 5 grounds for asylum. some HIV positive people have applied for asylum based on the fact that they were subject to persecution back home because they were positive, which would place them in a particular social group, another of the 5 grounds. but I think that would be very difficult to maintain with hep B particularly if it's endemic in your country. |
