Can I request a nullifcation for a Permanent Resident holder spouse?

My wife who had come over from a foreign country early last year had left me after 10 months after receiving 10 yr green card. And now she is filing for a divorce..She left 2 days after receiving her green card .. She received 10 yr GC because it took more then 2 yrs for processing the visa thus making her eligible for 10 yr card. I only lived with her for 10 months?
Can I claim that she married me for a GC?

You can claim that she married you for Green Card if you have proofs or documentation to prove it. Otherwise, she could file for divorce and still stay legally as a green card holder provided she could prove that she entered the marriage in good faith and for some justified reasons the marriage didn't work.It would have been easier for you if she was just issued a Conditional Green Card (2 years) because she will not be able to Remove Conditions without you when her green card expires. |
