I am a British TV/ Film University graduate with a BA (honors) Degree in Film Production.
I have recently moved to America, and have good enough credentials to work on an O-1 (Extraordinary Artist) work visa.
My question is this: due to the current economic/ job situation, all the film/ TV jobs I am qualified to work for on the O1 visa are fiercely competative. In order to secure a position I cannot give my prospective employer any reason to hesitate in hiring me - and I am not legally allowed to work without an O1 visa, which takes around 4-8 weeks to be approved once I apply.
I have now been unemployed for a year, because as soon as I mention the fact that I have to wait 4-8 weeks to begin work, the interviewer basically yells 'Next!'
I would like to know if anyone knows if it is legal for me to start working for my sponsoring employer before my visa comes through/ is approved (even if only on an unpaid basis).
Any advice anyone can give me from their own personal experiance would be hugely appreciated!

No, but your prospective employer could use the premium service for an additional $1,000 and get it processed in 15 working days. Assuming you're worth the extra money, of course. |

Talk to the employer. Tell him you are waiting for your O1 to come through but are willing to work as an unpaid intern until the papers come through. Technicaly you are supposed to have a work visa or training visa even as an intern, but nobody really checks. |
