I am a mother of a newly born United States Citizen who came in the United States on a B1 Visa as a domestic employee since 2000. My B1 Visa was renewed every 2 years and finally received a 10 years B1 Visa from 2006 to 2016. Unfortunately, due to my employer bad treatment and low monthly payment to take care of myself and living, she asked me to return back home after using me for long time with low monthly payment and no benefit. I was pregnant at the time my employer asked me to go back home who also a Non-Immigrant. I decided to move out and stay to a Crisis center with my 6 month pregnancy until when I delivered my baby in the United States a month ago. I would like to know if I would be eligible to apply and change my status and to what type of status?

If you were working in the US under a B1, you were working ILLEGALLY. If you have not been paying your income taxes, you are a criminal alien.
Your child a US Citizen can NOT sponsor you, until the child attains the age of 21.
So, sorry your anchor baby can NOT apply for you to enter the US for 20 years and 11 months. |

your case is complicated, seek legal help, ie an experienced Immigration lawyer in the city/town you are in.
The crisis center you are currently staying at might be able to refer a lawyer who will look into your case. Dont waste time, start on it IMMEDIATELY.
I doubt if you are in legal status at the moment since B 1 visa holders are not allowed to work as demestic help in the US.
Anyways even in the event that you are eligible to change status to another visa type , you have to leave the US, go back to your home country and apply for new visa/change of status at the American embassy in your home country.They no longer allow change of status from B1 to another class of visa when you are still residing in the US.
Best option for u now is to speak to a qualified/experienced Immigration lawyer as soon as possible. |
