I'm not sure how to ask this question, but I'm wondering if a person who is not immigrant marrying to an immigrant person who's not yet a citizen, can the non-immigrant person apply for a green card?

What you are meaning to ask I believe is whether or not a non-immigrant (temporary visa holder) obtain lawful permanent residency (green card) by marrying someone who is already a lawful permanent resident. The answer is yes, but there are restrictions. First, the person that is already a lawful resident must have been in this status for a certain amount of time. I believe that time is 2, 3, or 5 years. Second, the non-immigrant must be in the United States legally, or have no history of deportation or unlawful presence in the United States. It's more complicated than this, but I am providing the general information. If the non-immigrant has a history of immigration problems which could make him or her inadmissible under section 212 of INA, it would substantially hurt any efforts to make them legal through marriage to a lawful resident. |
