Here's the deal: My girlfriend is an illegal immigrant from Mexico who came here when she was eight by her parents. Her mother has a working visa, but cant do much for her daughter. Her uncle has some sort of petition for her also, but we were looking for some kind of advice. We want to rent an apartment an id really like as much info as i can get to move her in even if i cant fix her legal status. And no, she cant return to her home country. get real. this place is all she knows and is actually going places unlike some citizens of this country

If your main concern now is being able to live with her in an apartment and not fixing her status though, then I don't really know what the problem is.
If she had a student visa previously and is now out of status, then it is still fixable through marriage. I wouldn't count on the uncle's petition, to be honest. Her overstay will jeopardize that petition anyway, and the overstay will not be forgiven since the petition is not from an immediate relative. Her only chance is marriage. Overstaying and even unathorized employment is usually forgiven in spouses of US citizens, as stated in the Immigration and Nationality Act. |
