They could be imprisoned for not having a valid license and from there if found out to be illegal, burned over to ICE. From there, be deported if proven to be illegally in this country.

They can, however, where I live the INS is so far away that they usually lock them up and let them go. They are told to contact INS to upgrade their immigration status but it's not followed up on. I do know of one severe case locally that involved a wreck that killed a woman. The driver was illegal and law enforcement contacted INS due to the severity of the offense. I know that if INS is close they are more likely to deport. For instance, El Paso, TX or San Diego, CA. |

It would depend on the state, the cop, and the mood the judge is in. If you are arrested and it's found you are an illegal immigrant chances are your going to be deported. |

are you kidding-----with the amount of funding available for keeping them illegal.....there is more 'use' for those outside the law than those who uphold it......most authorities do nothing because of the cost involved in processing the illegal criminal.....in other areas....their vehicle is impounded and they are given a citation....that is if they can even determine which Manuel Garcia Trujos Guiterrez Villa he actually is........lol |

Yes. It is illegal for them to be here and illegal to drive without a license. Why should we keep illegal people here that don't obey our laws.
There has been so many incidences in NC the past few years of illegal immigrants driving without licenses, driving while impaired, driving under the influence and driving the wrong way on a one way highway causing many fatalities. They should have been deported before they caused these deaths. |

Illegal immigrants can be deported for any reason since simply being in the country is illegal. So, if he or she is pulled over by the cops and is discovered to be an illegal resident, they can be detained and deported back to their country.
Under our system, they are not entitled to the same rights as an American citizen.

I would suspect so, since the law was broken by not stopping and not having a license. Legal penalties would apply to any US citizen so if an immigrant were here and not legally in our country it would seem foolish for the authorities to just let them go. |

I don't care what anyone else tells you on this board. My husband was an undocumented resident and he was pulled over with nothing but a passport. They gave him a ticket and let him go. It all depends on what the cop wants to do and most of them don't want the extra paper work. |

An illegal immigrant can be deported for simply being here. They do not have to commit a new offense to be eligible for deportation. However, being arrested can make it more likely that the illegal immigrant may be deported because some law enforcement agencies will report them to Immigration officials, who may or may not come pick up the person. There are many factors involved, including the location of the jail the immigrant is located, and how many other immigrants that jail has to be picked up. |

Yes, of course they can, but it rarely happens. In some states, illegal aliens are allowed to get licenses. It is a shame that some states and cities make it easy for trespassers to the USA to live and work in our country. |

Police do not usually check to see if you are born American or not, and it would be silly to start without having a reason to check
You would probably ask any one with a brown skin and an accent, but that just isn't good enough these days |
