Hi everyone! i am an american citizen and i am planning to go back to the philippines to finish college. my fiance lives there and we have been together for 5 years and engaged for over a year. does anyone know if i can apply for her fiance visa there in manila?

No. You must apply for it back in the USA via the USCIS. Once issued it must be used to enter the USA within 6 months. Once in the USA your fiance must get married to you within 90 days.
You can get married in the Philippines about 6 to 8 months before you come back to the USA. Since you will be living there you can file a spouse visa through the US embassy in Manila. This is called "Direct Consular Filing."
This type of filing is much, much faster than doing it back in the states. When you get to the states you can always get married again. This second marriage will just be considered a renewal of your vows since your legal marriage would have been in the Philippines.
By doing a Direct Consular Filing, for a spouse, you can get the CR-1 Visa which means your new spouse will not have to adjust status once in the United States. The Green Card will arrive in the mail about 4 to 6 weeks after you both arrive. |
