my boyfriend got a DUI and hit and run when he got sent to mexico but they have him a court date for 2 moths after he got sent when he was trying to come back he got deported for 5 yrs can he come back after dat we have a 1 month old baby he got send when the baby was a 1 week old im a legal resident.

It sounds like he is inadmissible for five years due to section 212(a)(9)(i), previously removed as an arriving alien. In order to come back to the U.S., he would need a waiver of that grounds of inadmissibility. If he was found to be an immigrant without an immigrant visa at the time of his removal, he will also need an immigrant visa.

His chances of receiving a visitor visa are extremely poor.

You can petition for him as your spouse if you decide to get married outside the U.S., but that type of visa takes about 5 -6 years. Your best chance for reunification would be to live together outside the U.S.

If he got deported for 5 years, he is not guaranteed getting back in. He would need to apply for a visa, which could be denied if they thought he was not going to return back to Mexico after his visit.

If you really want to be with him, you will need to move to Mexico
