Can my husband obtain US citizenship based on his father's nationality ?

My husbands's father was born in the USA, holds a US passport but has lived in the UK since he was a baby. My husband was born in the UK and holds a UK passport. We are looking into emigrating to the USA. Would my husband be able to get US citizenship based on his fathers US nationality/passport ?

Depending on the year your husband was born, his father would have had to live in the US for 5 or 10 years in order to pass down his citizenship. If his father did not live in the US for several years after he turned 14, his son is not eligible.

Your husband's father probably can't pass along his U.S. citizenship unless he himself lived in the U.S. for several years before the age of 14. Check for the law that was in effect at the time of your husband's and your father-in-law's births.

The father should have fulfilled the residency in USA requirements. Since he has lived in UK since he was a child, he did not qualify for the residency requirements.

And since the father did not qualfy. the son is not eligible for US citizenship.
