Hi, i have my papers in immigration for abt 3 yrs now my case is still pending ... i have a kid that born here and my mother is citizen.. i need a permit to go and visit my brother he is sick .. what can i do ?? is the form I-130

If you're in the US and you're still in the middle of adjusting status, you need to apply for Advance Parole through USCIS. If you get it, you can leave and return legally. If you leave without it, you won't be able to get back in until you get an immigrant visa.

www.uscis.gov go to this website. the i-130 is immigrant visa i belive that is the wrong one for you case right now. it should be i-131 or i-192. you can get phone number from website to help
