i brought my kid to stay with his grandparents in PI. immigration at ninoy aquino airport 'forgot' to stamp his passport upon entry so now the burden is on me to get proof that he entered the country legally. im going about that right now. anyway, then the issue came up of his citizenship to stay there. everything ive read, even the constitution of the philippines, says he would have dual citizenship because his mother is a filipino and he also has an NSO Certified birth certificate but because I am his father and a US citizen, that he also has that citizenship. he has a US Passport. however, the people my inlaws have spoken to at the Dept of Foreign Affairs in PI are trying to say hes only a US citizen and has overstayed. seems like a way to scam ppl out of money. does anyone have any info on this or has been through this ordeal in the past?

No dual citizenship. YOu should have reported the birth to the US Embassy when it happened. Now you will have to do the long process !i

The DFA doesn't determine who is an overstay and who isn't. That's the BI's job. I assume he has a US passport and that's how he entered the Philippines. If he has a Philippine passport there would be no issues.

If he entered the Philippines at the same time as his mother, coming back as a balikbayan, he should get a 1 year stamp in the US passport.

Since the kids was born in the Philippines, to a Filipino citizen, the kid has Philippine citizenship as well as American.....

A child born in the Philippines to a US Citizen father, can apply for a CRBA (Child Report on Birth Abroad) in the US Embassy. He can claim for US Citizenship but has to provide proof that the relationship between the parents exist. Once approved he will be sent a US Passport. But the Philippine immigration will compute for an overstaying fee from the time of child's birth. The reason they gave me was he was already born a US Citizen. But when we left the Philippines, I did not pay for my sons overstaying fee because he has a Philippine Passport. Just show this upon departure. Once you arrive in the US, just apply for his dual citizenship in the Philippine Embassy to avoid paying fees going back in the Philippines.

my child's father is a us citizen and resides in the u.s. zero communication for 7years.my child and her father now communicate since 2007. he sent 3thou pesos march 2011. i want to get the right support from him not only the amount he want to send but the right amount. 3k is not enough. thank you and looking forward to your answer.
