Do i have to have permission from childrens father to take them abroad or live abroad if were not married?

Im just wondering if i wanted to move or visit another country then would i have to have permission from my kids father? we are not married, never have been and we have never been through courts or anything about the children.

If his name on children's birth certificate, then of course u need his permission to take the children out of country, unless u have already agreed (in written) that u can take children out of country for holidays.

As far as moving out of country to live somewhere else, u must have to have his permission, if u don't do so he can file the kid-napping case on you & will win children's custody from you.

having said that, the father of the child is STILL the father of the child regardless of whether the parents were married or not.

Reverse your question, how would you feel if the FATHER just took the kids, to a different country? Wouldn't that be wrong?

If it is wrong for him to do to HER, than it is wrong for her to do to HIM.

If he's paying child support and in the children's life then yes you do have to get permission.

I know this because my best friend moved to WI when we were 17 and after having her son with her ex boyfriend she wanted to move back to Okla. because he paid child support and was in his sons life he wouldn't give her permission and the courts said if she went without his consent then it would be considered kidnapping, and yes she was the primary caregiver.

Yes. You need the fathers permission to get a passport for 1 thing.
Another is the the international laws on parental abduction. If you were to remove the child to the UK (just an example) and the father filed a complaint you could be arrested in the UK for parental abduction. It is best to get the fathers consent in writing or a court order giving you full custody. Marriage has nothing to do with it nor does the birth certificate. The fact is that he is still the father and still has certain legal rights until a court changes those rights.
As far as saying that you don't know who the father is: that constitutes visa fraud. In the US it's 10 years federal prison. Other countries may not be as nice! Do you really want to commit visa fraud?

It doesn't matter if you are married or not. You need his permission to take the children out of the country, even for a visit, unless you have a court order granting you sole legal custody. If you take the children out of the country without his permission, it is considered child abduction, which is a crime and you could go to jail for it. If your home country and your childrens' father's country have a reciprocal agreement, you could even be arrested in your home country and the children would be returned to their father

The fact that you're unmarried is irrelevant, if he has parental responsibility then you need his permission to take the children out of the country.

Even if he doesn't have parental responsiblity, you should still consult him & get his permission (in writing) that he is aware that the children will be leaving the country and he is in agreement with it. Try to get it witnessed if possible and put arrangements in place for visitation.

You should really consult a solicitor, they'd be able to go through the implications of taking the children out of the country and international law relating to child custody & abduction. If you can't afford a solicitor, call your local citizens advice bureau, you may be able to speak to their solicitor or recommend a source of free legal advice on children's law.

It's always best to ensure that you know exactly what the law is on the issue and make sure you adhere to it where possible.

Yea you would! That's just wrong and completely selfish! Why would you want to split your kids and their father up? It can be very emotianlly damaging. I can guarantee they'll resent you for it later in life.

You don't have to. But just to be safe its a good idea to have a notorazied document saying you have permission (if he goes for the idea). Otherwise if you get asked by customs which I can atest never ask this: say you don' t know who the dad is.

Hi, I am divorced and now remarried with 3 kids - my eldest 2 children are from my first marriage and I have one 5yr old with my current husband.
