Hi everyone! i am an american citizen and my fiance is a filipina. I recently came home from the philippines before graduating college because of an excellent job lead however the company has suffered due to the economy so they had a hiring freeze. I am currently unemployed and i am planning to go back to the philippines to finish college. Can i still file for fiance visa for her even if im unemployed? if i can, i will apply before i leave...

No, you don't need to be employed to file, but you do need to be employed for her to actually get the visa, unless you can find someone to file an affidavit of support for you. However, considering that it will take USCIS up to a year to simply process the petition, maybe you will be employed by the time your fiancee is interviewed. |

You have to be able to prove financial responsibility for this person. As an unemployed college student, I do not believe you would be able to do so. Sorry. |

yes! And one of the first requirements : how will you support her? and then, both have to write a letter to the gov "an oath" where neither you or your fiance will ask for help or support to any kind (aid) from the government in the future. |
