Do you believe offering illegals in state tuition is unfair to American citizens who apply?

Do you believe it is unfair and this lawsuit is justible? Why should illegals who should not even be allowed to attend colleges be able to pay less than an American citizen?
Do you believe we should see more law suits depicting the discrimination that citizens are seeing compared to these illegals receiving more than they should?

SACRAMENTO, Dec. 12 (UPI) -- Dozens of U.S. citizens allege in a lawsuit that offering in-state college tuition to illegal immigrants is unfair to official citizens.

The citizens ask in Martinez vs. Regents of the University of California that undocumented students stop receiving tuition breaks in the California school system, while documented students receive compensation for past out-of-state tuition payments, Stateline.org said Friday.

A California Court of Appeals panel ruled in September that the immigration tuition practice was in violation of federal law, giving the lawsuit a green light.

Utah Attorney General Mark Shurtleff, whose state also offers illegal immigrants discounted tuition, has asked the California Supreme Court to review that ruling.

"Though not legally binding on other states, its (the appeals court decision's) singular presence in the judicial landscape casts a pall over the viability of his public policy, not only in California, but nationwide," Shurtleff said in a letter to the higher court.

Stateline.org said the other U.S. states that use a similar immigration tuition system are Illinois, Kansas, Nebraska, New Mexico, New York, Oklahoma, Texas and Washington.

It is unfair and it is a violation of federal immigration law (aiding and abetting illegal aliens is a crime). Why should the taxpayers of any state have to subsidize the education of illegal aliens who cannot legally work in the USA? What is the point of that? We should be deporting more illegal aliens during this recession.

Anything that grants access to colleges funded by U.S. taxpayers that gives preference to non U.S. taxpayers should be stopped and those officials pushing such a thing should be removed from office. I have no problem with admitting foreign students. They simply should be in line after American ones. As for illegal immigrants, it's kind of pointless to enforce immigration laws if we are going take wealth by force from Americans and give it non U.S. citizens. As for private institutions or private donations, it's their money, they should be able to spend as they see fit.

we are citizens of this country therefore we should get the upper hand... plus our parents and guardians pay taxes and such.... the illegals don't, why should they get all these benefits? if americans went to mexico illegally... they would give us s**t.

They are here illegally and no US institution has the right to assist them in any way. Why is it that middle-income people who can't afford to send their children to school never get any tuition assistance but illegal immigrants do?

This should be a cut and dry thing and no court system should be needed to resolve this what so ever! The legal system should not even challenge this.

When Congress passes a guest worker program all immigrants should be required to comply with the law. Shame on Republican fat cats who prefer low wages to legal workers. Shame on Democrats who think that flaunting the law to "help" individual poor is acceptable. Shame on both of them.

It is absolutely unfair. They are criminals, invaders, and should not be rewarded in any way. They should be arrested, tried, imprisoned, then deported. Their fingerprints & DNA recorded into the National Security database, and they should be permanently banned from ever entering the country again for any reason.

No, people pay in-state in states where they pay taxes. The vast majority of undocumented immigrants pay taxes (for services they do not qualify for or get). If they paid taxes in that state, yeah, they should get it. Most were brought here as kids and it's not their fault they're undocumentd. Most don't have a way of legalizing themselves and have families that have paid taxes. If a U.S. citizen didn't pay taxes in that state, they don't deserve in-state. Go to the school in the state where your parents paid taxes instead of trying to leech off other state's tax payers.

no i don't think it is unfair, if the illegal immigrant was coming from out of state then they would also have to pay out-of-state tuition, its not discrimination towards the american citizen but towards the undocumented student who most likely didn't have a choice in becoming an illegal immigrants who is just trying to find a way to self betterment and not have to go back to a 3rd world country and live in poverty. tuition should be based on whether you can prove you have lived in-that-state like its always been.
