Huh? I don't know where you get your info from, but your facts are misconstrued. Identity theft is NOT legal, period. If you are insinuating that illegals don't get punished for it, you are partly right, but it just depends on where you live and how far they are willing to prosecute the person. Many states have adopted to charge illegals, when caught with the wrong identity, with identity theft, however, in a lot of cases, the law does not know what names or SS #'s they are using, so it would be hard to prosecute these cases.
