A militia can serve to supplement the regular military, or it can oppose it, for example to resist a coup d'état. Under the constitution the congress provided that the federal government could not infringe on the rights of the states to maintain their militia by ratification of the Second Amendment. As to the question that was asked, it depends upon one's interpretation (or rather strict interpretation) of the Second Amendment to the U.S. Constitution. State militias have been used in the past in times of public danger and also to supplement military forces during times of military need, such as in the Civil War as well as the Spanish-American War. As to the question of invasions, I am going to interpret the question as encompassing the illegal immigrant invasion that has been experienced during the past several years. Based upon the foregoing, my opinion would be to answer the question in the affirmative. The federal government, for whatever reason or reasons, shows little substantive interest in protecting our borders, or the lives and property of the citizens who legally reside within those borders, or the general economy of the U.S. against the invasion that we've experienced and continue to experience and will continue to experience, failing action to stop the invasion.
Texas, for instance, entered the union and became a state (it was the Republic of Texas prior to entering the union) with the specific condition that the United States government would protect the state's border from invasion by foreign forces. That protection has not been forthcoming. Therefore, I would firmly accept the proposition that Texas would be entirely justified in forming its own militia to enforce its borders; borders that the U.S. refuses to protect in any substantive fashion.
Further the assertion that all state militias are under the sole control of the President is not entirely true, The National Guard forces are certainly under the control of the President. However, there are other legitimate and entirely recognized State Defense Forces (aka: State Guards or State Military Reserves) that, under federal law 32 USC Sec. 109 , are independently controlled by the governor of a state. This law provides that State Defense Forces "may not be called, ordered, or drafted into the armed forces" (of the United States), thus preserving their separation from the National Guard and someone like El Presidente Jorge Bush. |

That is what the national guard is. If you mean setting up local militias outside of state control, you already can do that. Just make sure your weapons are legal and you do not have criminal infiltrate it. We had one in my area that was doing good, unit a drug dealer and his friends got involved. After that they feel apart and most of the members left it. |

We already have state militias. They are called national guard units. Remember that under the constitution, all armed forces, including the federal forces as well as the state militias, are under the ultimate control of the president. |

Hell, No! A sizeable percentage of our population is nuts. I don't want these people to own guns much less get together with those guns and decide to enforce their own doctrines. Look at it this way. In most areas of our culture, we have to do something to qualify to have power and authority. A teacher has to get a degree. A doctor has to get advanced degrees. A cop has to go to police training. The only thing a gun owner has to do is pass a simple background test and have money. Please, let's not have those people get together. |
