Extension Denied! Can you get back into the U.S.?

My friend was here on a travel visa (was here for 6 months). He wants to go to college here. He sent out for an extenshion so he could look at more colleges to attend this fall. He got denied. He went back within the 30 days the government gave him. He has been gone for 2 months. He has a 10 year travel visa. Will he have a problem getting back into the U.S.? He will be coming back in 3 weeks. He is going to stay for about 2 months so he can finish looking at schools. He has been gone since January 2009.
Anyone here ever get let back in after leaving for only 2 months?

He has already expressed a desire to attend school in the U.S. The last time he was here, he stayed well beyond the six months he was given. Although he did not accrue any unlawful presence, he still was in the U.S. for a very long time.
After spending less time outside the U.S. than he spent in it, he wants to come back for another two months to try to accomplish what he failed to do before?
His chances of being admitted are lower than his chances of being denied, but we'll never know until he tries to enter. |

He is likely to be considered an immigrant rather than a bona fide
visitor and may be denied entry or held for exclusion. If he wanted
to find a school, he obviously had more than enough time to do so
while he was here. |
