F-1 Marrying a US Citizen?

Hi Guys,

My girlfriend and I are planning to get married. She is a US Citizen and I am under the F-1 Student Visa. I'm currently under OPT which expires in July. My question is, what is the specific visa for my case (I live and work in the US) and if I file for that certain visa, will I automatically lose my OPT work authorization.

As noted, once you get married and your wife files all the proper paperwork, you will also be able to apply for work authorization. At that point, you can either continue to work for your OPT employer, or anyone else for that matter. The OPT option sort of becomes superfluous. Check out uscis.gov and look up the form section. read the instructions on the I-485 and you'll see what you need to do. there are other sections on how to adjust as well. lots of useful information there.

After you marry, you need to file forms i-130 and i-485 to apply for a green card. You can also file for a temporary work authorization permit with your green card application which you will receive in about 3 months. Your OPT will still be valid till expiry.

If you get married in the next few months and your wife files the application to adjust your status immediately,then you should get approved for you EAD within three months or so.

Is there anyway for you to apply for an extension?

You file for an adjustment of status. At that time also file for an EAD. An EAD will take about 3 months. You can still work on your OPT. Just file soon enough to get the EAD before your OPT expires and you should be OK.

Don't take a chance. See an immigration consultant with experience with the K1 and K3 visa. Yes it will cost more. It is well worth it in the long run. And you need to do it really soon, before your OPT ends or you may be visiting your home country for a few months while the paperwork clears.
