hi, i am planning to get my boyfriend in the philippines he's the father of my daughter... im here in california right now with my baby.. i would like to ask if i can file a fiance visa even without a job? and can i file the said visa when im in the philippines? because im just having my vacation here in states. i cant stay here without him so i wanna know if i can file a fiance when im in the philippines?
please somebody help me

As long as you can find a cosponsor, with a job, you can file the Fiance/Fiancee Visa petition. However, you can't file it in the Philippines. You have to file it with the USCIS Service Center in the US that's responsible for California. A K-1 (Fiance/Fiancee Visa cannot be filed outside the USA).
If you actually LIVE in the Philippines, and you can find a cosponsor in the USA with a job and qualifying income, you could get married in the Philippines and file for him there as your spouse. You could file for either a K-3 (non-immigrant spouse) or CR-1 (immigrant spouse) visa.
By filing the K-3 or CR-1 in the Philippines you will cut about 6 months off the processing time. The K-3 will require him to "adjust status" once he's in the USA. The CR-1 will require him to do nothing further once he's here. |

i cant stay here without him - YES you can. Plenty of other couples are apart while they go through fiance processing, So you should be grown up enough to do it too.

For a K-1 fiancee visa, you need to have a home and income to be able to show you can financially support him. If aren't set up to do that in the US, you will probably run into problems. |

You said you are just vacationing here in the US with your daughter?Does that mean you are here on a tourist visa?If you are, you cannot petition your fiance because you are not a US citizen. Only a US citizen can file a K-1 or fiancee visa petition.However, if you are an American citizen you should file it here initially in the US and it should be approved here first before it will be forwarded to the US Embassy in Manila for your fiance scheduled medical and interview. |
