Green Card through marriage?
Find answers to your legal question.

Green Card through marriage?

I came into the US through marriage. My GreenCard is valid only for 2 yrs. Although it does says "Permanent Resident Card" I was told by that my status is not a permanent in the US. It is called "conditional resident". My question is do I file the I-90 application form or I-751? I do understand the purpose of the 2 different applications. But I am asking this ? because someone who has a same case filed form I-90 instead of I-751 which 's feel is lower than I-751. I don't want to waste extra hundred something buck if I am okay with filing I-90 and removes the conditional status. Is he/she will have problem when applying for N-400 in the future because he/she didn't removed the conditional status (I-90)? If anyone have went through this or know someone who has. Thanks in advance

I also thought I-751 is the correct application form to remove the conditional status but since someone I know is on the same status has filed the I-90 form and has received a new GreenCard. How did that happen? How come the USCIS did not reject his application? I am confused. How did he got through it?

As others already mentioned, at least 90 days before your conditional resident card expires, you must file the I-751 for permanent resident status..
Basically, you were granted conditional status because you were married for less than a year at the time you filed for permanent resident status. The 2 years of conditional status are to ensure that you did not just marry for the greencard (you have to stay married for 2 years before you will be a full fledged permanent resident).

Perhaps the person you mentioned who filed I-90 just received a new conditional status card, or they were already a permanent resident (NOT conditional like you) and filed to renew their permanent residency.

90 days before your card expires you and your husband file the I-751 with USCIS. If the card expires BEFORE you file your chances of being denied and asked to leave and start the process all over again are excellent.

Once your conditional status is removed you'll receive a card that's good for 10 years and be a permanent resident.

you have to file the I-751 with the necessary evidence

This was carefully explained to you at your AOS interview
Follow the flowcharts here

pay attention now; 90 days before the two year period expires, you must file I-751 for removal of conditions

Try looking at "uscis.gov" for info on this problem. I believe you can also enter you name & # to be notified of changes or what is happening to your case.
Good luck!
