He has 3 years probation, what are the odds of him getting deported at his deportation hearing?

My boyfriend is getting out in a couple of weeks with 3 years probation and restitution due in August 2009, he has a job waiting, and I am getting him a place to live after his probation officer approves it. He has been in this country for 10 years legally with no legal scrapes. I am freaking out because I think he might get deported. They are taking him to immigration court after he gets out. What are the odds that he will get deported? What do we need to do to make sure this does not happen?

I am a do it your self promoter but this is when you need the advise of lawyers. So your first assignment is to consult with as many lawyers as you can and if you see fit, hire one. It is better to make an informed decision based on the law than just simply here say.

See, you did not say what your boy friend was in jail for and how long he was in there for. If you said, he is here legally then he must be a permanent resident and not a citizen because he will not be dragged to immigration court if he were a citizen. I take it his visa has not expired yet, if it did and it were not renewed then that would be a problem with a criminal record. You also did not address the fact whether he is in for a felony or a misdemeanor charge. A felony case is something serious.

Based on your last question, you have to understand that there are no guarantees. You cannot prevent things from happening but it is all within your power to change the out come by preparing for the eventuality that he will soon be released. Instead of worrying and doing nothing, be empowered by knowing as much of his case as you can. Going to immigration lawyers, consulting with them and seeking their expertise and finally hiring legal help, if you must, to resolve his case. I wish you the best.

If he has 3 years probation then he was convicted of a felony (2 years max on misdemeanors). So he is gone for around 10 years and there is nothing you can do. If he flees or re-enters the country then he will face a lifetime ban.

What are the charges? If they are taking him to immigration court I would say his chances of deportation are pretty good.

he has been a guest of this country for 10 years and has broken the law, he has a greater chance of being deported if his charges were felonies. It will be up to the judge.

If there are felony convictions, whether the person gets probation or prison, he is very probably being deported. Legal immigrant or illegal alien, any non-citizen with any felony conviction is subject to deportation and permanent bar to reentry. Since he has an immigration hold, it appears that this is a serious felony which will result in deportation and permanent bar to reentry.

You will have to join your bf in his country if you want to continue a relationship with a convicted felon. He's not coming back.

Someone who is this country without citizenship commits a crime, especially one for which he serves time, absolutely SHOULD be deported.

His chances at deportation are very great. " He was here LEGALLY for 10-15 years " does not mean he was here at the time he committed crimes.

If you want a good answer we need to know what the charges are. There are several crimes that you go to jail for and no big deal but some are reasons for instant deportation. I would say that if they are taking him to immigration court then one of two things is happening he's getting deported when his sentence is complete or he is actually under immigrations jurisdiction and they are handling his court because he is an immigrant legal or not if he is not a U.S. citizen yet then they have jurisdiction.
