the forms i sent are the i-130 and the i-485 (1365.00$) bank of america did a mistake and they are willing to send me a letter saying it was there fault but what will immigration do...
*** i had already received the "receipts" for the forms i sent from immigration

FYI:::: I called immigration and they simply said i would receive a letter in the mail giving me 14 days to send the payment but they will not send me the package back or anything of that sort thank you for those who took the time to answer except the weirdo with the first answer

Call USCIS and explain the situation.
When USCIS receives checks, they are scanned for instant electronic transfer from the bank account of origin. Which means, USCIS will either re-try to withdraw the funds from the bounced check (provided it isn't on its way back to you), or you will get an RFE for a new check or a money order. Which basically means that your case won't see any FURTHER action until the money situation is cleared up.
Really, the only time a petition is returned to sender is when the check is incorrectly dated (some people make the mistake of postdating their checks), or if the amount written on the check is incorrect. Once you get an NOA-1, that means action on your case has already begun (or, your file has been "touched"). The NOA-1 is indication that your petition has already been processed; this can't be undone. From point of processing, it can only be denied, and that's based on the contents of the petition, NOT the fee(s).

If the check you sent bounced or has no funds the USCIS will return back your entire package.You will have to re-file again.Even if they sent you already the NOA1 or Notice of Action for the receipt for your application it will still be sent back to you.They will not process it without the fee. |
