Hi, I am trying to get some proofs of my US residency status for the past 8 years. Can anyone help me here?

I have tried to find my old utility bills as well as bank statements, but out of luck. The only evidence I can find is from 2003 to present. I originally came to the US in 1999 as an Alien then became a US citizen in 2004. Now, in order for my 3 months old daughter to get her passport, the US consulate in Shanghai needs me to prove solid evidence to demonstrate that I was living in the US for more than 5 years before her birth. I need help here, please.

Yes, I got my citizenship based on marriage. In March 1999 I came here as a none-immigrant. Unfortunately, I couldn't find my old passport any where. In November 1999 I got my work permit as well as my green card. Since then I have worked and paid taxes. Just 2 weeks ago, I got copies of my tax return transcripts from IRS for the years of 2000 through 2003. However, the consulate officer here still believes that the tax return transcripts are not good enough to prove my residency status. I have also pulled my DMV record which also shows that the DL was issued in early 2000. Still with all these docs, the consulate officer won't approve the Consulate Report Birth Abroad application.

Show them the Immigration Statute. You must be a green card holder for three years if your residency (green-card) was based on marriage, before you can even apply for citizenship and five years, if some other way. Additionally, you said you initially came as a non-immigrant, this means additional time; do a FOIA on yourself and file with the state department. Where are your records, old passport etc., did you work and or pay taxes. Those records are available from the IRS. Did someone claim you as a dependent, that helps too. Presence does not mean you never went out of a country to visit.

Either you are naive or withholding some information.

Additional Comments: This is very strange indeed. You must ask them what precise documents do they need and why the documents you have already submitted is insufficient. Also ask for the statute/policy they are relying on. This is not a matter of discretion, just clear and convincing evidence. Find out who your congressperson is when you were living in the States, begin contacting them after you get a written rejection. You must tell them that you will be returning to the city/town etc. So they know you can vote foe for him/her.

You can always get her a passport here in the U.S. She is your daughter and was born after you became a citizen. Apparently her mother is as well.

By the way, transcripts are given a little less weight than the actual copies of your certified tax returns. You should get them too, you have to pay about $45.00 for each year of copy of your tax return. Offer to provide certified copies to them, especially, if the copies include an address in the US. Otherwise it would be useless.

FOIA: Very fast for your situation. There are mandatory time limits; you should have the answer within 45 days. To save time send a declaration under penalty of perjury identifying yourself and provide identifying information i.e., drivers license, passport number or some similar information.

Otherwise, they tell you we need to be certain you are whom you say you are and cite privacy laws. LOL. So this way you deprive them of excuses. I think you are dealing with some clerk at the embassy who does not know the laws. You might want to cc., the top person at the embassy too. You can get information on where to send the FOIA request on the State Department website, perhaps even that embassy site.

If you are still married, the child should be a citizen without the
residence requirement. If you are the mother and not now married and the child was born out of wedlock, only one year of residence is
required.

If you are unable to satisfy the consul, you can petition for an immigrant
visa for the child.

Try getting copies of your W-2 tax forms from your employer. or even your 1040s from the IRS. Also, your credit report lists your previous addresses. You can get them from www.AnnualCreditReport.com for free.
