How Long Can Green Card Holders Stay Outside U.S.?

How Long Can Green Card Holders Stay Outside U.S.?

According to USCIS's website, green card holders can stay outside America for up to a year. But WHY some people KEEP saying green card is only good for 180 days outside America and if you wanna stay for more than 180 days, you have to apply 3 months in advance for extension from ports of entry??

My aunt is a green card holder and for health reasons she needs to stay in her home country for at least one year. (She didn't apply for re-entry permit before she left) But somebody told us to go apply for extension before the 180th day of her stay in China, or her green card will be revoked. IS IT REALLY????

I've written to the Embassy inquiring about the maximum duration, but havn't got any reply. Would love to hear your advice:)

BTW, she now has developed cancer. Will her health conditions affect her readmission into America? Does Ameria only accept healthy residents EVEN IF she already has a green card?

Many thanks in advance.

The law never changed. However, green cards are issued to people to allow them to live primarily in the US. so, if a person is spending more than half the year outside of the US, there may be more questions for them when they return. No one automatically loses green card status for being outside of the US for over 6 months, but they do if they're out over 12 months. Generally, a person won't really have a problem getting back in before the 12 month period has expired, unless they have established a pattern of living back home but returning to the US for short vacations. A green card isn't a permanent tourist visa and if a person continues to use it like one, then they run the risk of losing it, even if they're never out of the US for more than 12 months. But, that's a judgement call on the part of the CBP officer at the airport.

1 year.

2 years with re-entry permit.

Health conditions will not affect readmission.

ok here it is its no more than 180 days cause according to them if you out more than 180 you no longer reside in the us there for u no longer a permanent residen my gramma was out more than 6 months and th officer asked her why she told him she was sick he kindly replied ok but no more than 6 mo. i haerd they have cut back to 4 months now i ben out more than 6 months and when asked i alway say 30 days they have no way of knowing how long u ben gone since the dont stamp you on your way out so its really based on luck you kan also renew your passport and it will not have any stamps and just say 3 months when she comes back

So if i was out for 3 years and didn't have a permit to cameback and i still go, will they see that i was out 3 years? because they always ask me how long have you been out. so if i say 5 months i may have a chance that they don't check right? thanks
