It is a lot better to go back to either his country or Mexico and married him there then file the Form I-130 and choose to follow either of the paths below: This is very long to write so I am going to give the website that help me when I needed it: http://www.immihelp.com/visas/kvisa/ and look for Marriage outside the US. I chose the K3 Visa for him to arrive here in America quicker than all of other ones. If they know that he is here illegal and they will know if you married him in America because they will ask how he got there-they will take him back to Brazil and he won't be able to come back in 10 years so please don't take that chance. Just read Immihelp website and it should help you out. How long have you and your boyfriend been together?? Reason why I ask that is if you have been together longer than maybe a year and half then he does love you but if less than that- there is a chance that he could be marrying you just for the paper. I am not trying to scare you or anything but I have gone through it once. As soon as he got his paper-he left me so please just be careful. Good Luck!!

First thing you have to do is find out if you live in a state that requires an SSN to get married. If you do you will not be allowed to get married in that state. You would have to move to another state and live there long enough to be considered a resident of that state. You can not just go to another state and get married if the purpose is to avoid the laws of your state of residence (To avoid problems a lot of people get 2 marriage certificates 1 from their state and 1 from the state they are getting married in to be sure).
After marriage you file an application for him. He will be required to return to Brazil and 2 things will happen. He will be banned from the US for 10 years and your petition will be denied (this HAS TO BE DONE). NOW you can apply for a I-601 Application for Waiver. of Grounds of Inadmissibility (you will need a lawyer for this). If approved he should be back in the US in about two years from his date of departure!

If you are convinced that he is "the one," than you should seriously consider marrying him. Once you are married you can start the process by filing the I-130. once it is approved, he will have to go back for an interview to get his visa at the American consulate. He will be denied the visa because he was illegally present in the US for over a year. At that time, he will be instructed to file the I-601. You will have to present evidence proving that you could not live in Brazil. This would include evidence of medical problems you may have, financial obligations in the US, familial obligations (i.e. caring for aging parents or disabled relatives.) and anything else that would make it impossible for you to move to Mexico. You have to prove that the hardship would be ABOVE and BEYOND the hardship that could be obviously expected. This means that the fact that you love him and "can't live without him" would not mean SQUAT to the case. The good news is that 90% of I-601s are approved. If you are serious about your boyfriend and plan to marry him and go through the long process of getting him his green card, than you might want to talk to an immigration lawyer about your options.
