Find answers to your legal question.

How do I begin the process to emigrate from Canada to the US on a student visa?

I'm actually asking this for a close friend who is moving here. He is a college student who is wanting to go to school here and will be looking to work and become a citizen after graduation. He and I have been looking online on ways to start the process but many sites want you to pay and buy materials from them. It's daunting and I don't want to waste time and money going down the wrong road.

Can someone make any suggestions or point us in the right direction of how to begin the paperwork for him to obtain a student visa?

Thank you.

Don't pay for this information as it is readily available on the web free of charge. The following is taken from the website www.takingupresidence.com, hopefully, it will answer some of your questions:

In most cases, students interested in studying in the U.S. will need to apply for an F-1 (non-immigrant) student visa. An F-1 or student visa is for people who want to study at an accredited U.S. higher institution or who want to study English at a university or English Language Institute. While this is the most common type of visa for students, there are other types of visas, which may be more in line with what you need.

For instance, a J-1 or Exchange Visitor visa is for individuals who wish to participate in exchange visitor programs. In addition to being used for educational exchanges, the J-1 visa applies also to cultural exchange programs. The M-1 visa is used by those who wish to engage in non-academic or vocational study or training at an institution in the U.S.

Visa requirements vary based on country of origin; therefore, you must apply for your student visa, in person, at the nearest U.S. embassy or consulate. The UnitedStatesVisas.gov website provides information about the visa application process in each country and what documents you will need to bring with you. See our Visa and Permits section for additional information as well.

One document you will need to bring with you is your SEVIS (Student and Exchange Visitor Information System) document (either an I-20 or DS-2019). This document is issued by a U.S. college or university and is usually given to you after you have been accepted for study. SEVIS is administered by the U.S. Immigration & Customs Agency (ICE). More information can be found on their website. Note: there is a SEVIS document-processing fee of $100 for which you will need to show proof of payment.

Other important information you should remember when applying for your student visa:

A F-1 or M-1 visa cannot be issued more than 120 days before the actual start of the program in the U.S. (J-1 visas may be issued at any time.) However, you are encouraged to apply for your visa as soon as possible as the process does take time.

Even if you have been issued a visa to enter the country, you will not be allowed to enter the U.S. more than 30 days before the start of your program, if you are an initial entry student. Returning students do not have this requirement.

June, July, and August are the busiest months in most consular offices, and interview appointments are the most difficult to get during that period so plan accordingly.

apply to colleges. If accepted the college will assist him in getting the proper paperwork.

Tell him to contact the college he wants to attend... most state colleges have international student programs... Once he talks to them they will tell him what he needs... they're going to ask for bank statements ... why because they want to make sure his parents can pay for it... to be an F1 student you have to be at school full time... and to be able to work he can apply for OPT which is optional practical training... he has the option to apply a year after he's in school in the US or after he's done... i recommend that he get his OPT when he's out of school that way he can stay one more year after his graduation... this is what i did and i enjoyed my job because i didn't have to worry about school... let me know if you have any questions... to email me go to my profile... i

They need to get a US degree in engineering so they can find a job where an employer will sponsor them for a TN visa. After that, they can have the employer petition for an H-1B. Once they have that, they can have the employer petition for a green card. The process takes 10 years or so..
