Should I marry her down there and apply for K-3 which would then take about 6 months from what I hear of us waiting down there. Or if I apply fo the fiancee K-1 can I bring her immediatly with me to the states, get married within 90 days, and we can wait for her citinzeship while residing in the states?
My concern is that I want my soon to be wife and child taken care of under my medical policy. I went to a free clinic in Mexico and there where people bleeding all over, laying in the halls, coughing tuberculosis everywhere.
Anyone with any advice would be greatly appreciated.

So, if we went the tourist visa route, would she be able to stay for the 9 months, (we just found out yesterday) and have the baby there? Would they both then be citizens? Also I live in San Francisco which is a sanctuary city, not sure what that means or if it applies, but I do want to live there with my new family.
With a tourist visa would she have to return in like six months? to begin applying for a new visa?

The K-1 is the best choice. Getting her over here as quickly as possible is key and if you get married in Mexico it will cause a lot more problems than you can imagine. My brother married his girlfriend in Canada and ended up having to stay there, without leaving the country once, for 8 months to wait for the paperwork to go through or he would lose his status. |

A K-1 and a K-3 visa both take the same amount of time to process. Do NOT expect your wife to be in the US legally before the child is born. I also doubt that your medical policy will cover a person that is pregnant.

IF she can get a tourist visa that is by far the quickest way. I just doubt that they will give her one if they know she is pregnant and planning to marry you. That will make her an extremely high risk for overstay.
But if you have the money to get an immigration attorney you might ask, because they might let her in the country on compassionate grounds. I'm doubtful.
The big fly in your ointment is that you can't cover her under you insurance until you are married. |

Apply for the K-1 so in three months you know you her and your unborn child will be safe and not in any kind of health dangers. Do what your heart tells you, and do your best and congrats on the baby.....good luck |
