I married a lady by way of K1 fiancee visa 3 years ago. We had a child and she is now waiting for her permanent residence status however I now learned that she only married me for the visa and is having one affair after another and stayes out days at a time before coming home. She said if she had her citizenship that she would divorce me now and she shows no real interest in the child we have. I want to withdraw my application if I can since she married me under false pretenses and I want her to be returned to her country is I can make it happen. She is telling all our friends that she wants a divorce as soon as she gets her citizenship. I plan to go ahead and do the filing for a divorce next month (March) Since she is running around and married me out of false pretenses. Someone Please Help!!!!!!!!!!!!!!!!!!! What is the most aggressive thing I can do?

You cannot withdraw the K-1 petition. She already entered as a K-1, and you got married.
If you have not filed form I-751 to remove the conditional status of her green card, then you can write to USCIS and describe to them what you told all of us. They will want full data, especially her name, date of birth, citizenship and A-number.
If you two already filed form I-751 to remove the conditional status, you better hurry up with the letter describing how she married you just to get a green card. |
