You don't need an atty if its an uncontested divorce. Since he's illegal and not in the country you would follow the same protocol as a missing spouse divorce. You would file for divorce, then place a notice in the local newspaper. Your spouse would have a certain amount of time to respond. If he/she does not respond within that time then the divorce would be granted by default. |
