The same can be said for promotions. Let us assume that minorities have applied for promotions but are not getting hired. If they are highly qualified, interview well, and have the experience but are consistently not getting hired this may be a sign of discrimination. Before you can make this assumption you would need to know if they are the best candidates.

Most American companies, and even colleges/universities, are not racist. In fact, they are the complete opposite! They go out of their way to recruit and accommodate a more diverse group of people, even if these candidates are not the most qualified.

One of the absolute worst things a company wants to be accused of is practicing racism. No one wants to be affiliated with a racist company so if a company is deemed to be racist, they will lose profit and business. That's not smart business practice.

When I filed helping Filipinos file an EEO complaint I found out that racist employers go out of their way to hire immigrants. Racist don't hate the presence of other groups, they love to see other races as long as they serve them. They go out of their way to hire Filipinos, because in their culture they don't fight back. They believe the boss is the law. When I asked them to testify, only a couple of those who are Americanized were willing to speak, the rest backed down. Racist love the hire immigrants , because they can abuse them and are less likely to see the consequences of the law, becaue many of them come from countries where they can die speaking against the boss. Illegal immigrants are a racist dream. They can hire them and abuse them, and if the illegal immigrants speak out, the racist can have them deported .
