I am a Canadian married to my husband ( a US born citizen) for almost 3 years, I am currently living in the US, and the i-130 already has been approved, and we are now waiting for the approval of i-485.
We received notice in March 2008 to send in our Affidavit of Support and to send the i-485. Due to lack of money, we werent able to send it until September 2008. Now it's been 5 months, and I'm wondering when will we get the interview??? Or will I just get the approval in the mail?

Well, you're adjusting status in the US. The National Visa Center or NVC handles immigration petitions and interviews for people who will be processed outside the US at the embassies. Whereas you're adjusting status inside the US through USCIS. Processing inside the US usually takes a lot longer than doing it outside the US as USCIS has long backlogs. I'm assuming you have a work permit anyway and at least you're here living with your husband, unlilke all those other folks doing the immigrant visa interviews. While sending in the forms 5 months after they asked didn't help, it can take a lot longer than that. depends on where you are and the backlog in your area, but you will be interviewed at some point. |

There is a time limit on how late you can send in your documents after they've requested them. If you go over that time limit, they consider the application abandoned. When we were going through the process, that time limit was 3 months.
You need to make an infopass appointment to find out if your application is still valid. |
