How long does it take to receive a Fiance Visa?
|
My fiance lives in Ukraine and we got engaged this year. We want to get married around October November, so I wanted to ask, does anyone know how long it takes for him to receive the fiance visa?

Hi Anna..
I just brought my finance from the Philippines and it took us 2 years to bring her here to the US. I have other friends that have told me that is about average for the US. The US used to be faster before 9-11 and was about 4 months. I hope yours will be so. |

All the current answers are off, concerning Ukraine.
Once you apply to USCIS for permission for him to apply for a visa, it takes 6-7 months for the approval, if you have a lawyer file it (USCIS doesn't scrutinize the applicaitons from lawyers, but they scrutinize ones done without lawyers for the tiniest little thing wrong, and will reject it or ask for more information - which delays it).
You can get current processing times of these applications at the USCIS website: https://egov.uscis.gov/cris/jsps/ptimes.jsp
California and Vermont are the only service centers that process these applications.
Once you get USCIS approval, the State Department National Visa Center has the FBI do a background check on your and your fiance - this takes approximately 30 days.
When the background check is done, the NVC sends all the physical paperwork to the US embassy in Ukraine - which takes 30-60 days. The embassy won't talk to him about a visa until they get the papers.
When they get the paperwork, the embassy will mail an applicaiton packet to your fiance. This takes 30-60 days in Ukraine. When he has it, he will fill it out and make an appointment to go to the embassy for an interview. The US Embassy in Ukraine is currently scheduling appointments 30-45 days out.
If he is approved at that meeting, it takes 7-10 days for his passport to be returned, with the visa.
So, minimum of 9 months (average).
You can save time by having him do all the footwork shortly after you apply to USCIS. He needs documents translated, he needs medical exams and immunizations, and has to get a police report from every region he's lived in (which take 1-3 months to get, and are valid for 6 months).
When he finally arrives, make sure you marry within 90 days, and apply for his green card (which takes another 8-12 months). |

You do not need a lawyer. Lawyers make mistakes too, and there are a lot of unscrupulous ones that don't know what they are doing, will charge big fees, and will definitely cause big delays. If you chose to use a lawyer, do your homework and get lots of references. You can do it yourself. One answer mentioned visajourney.com. This was a wealth of information for me when my fiance came to the states. You've got some good advice, but one thing I want to add is DON'T make any definite plans or buy plane tickets until the visa is in hand. Many plans and much money has been lost due to unforeseen delays.
Good luck! |

Hi,
I am going through the fiance visa right now and don't worry too much.
They guy who answered you two years had for sure some problems on his application. The average time is 6-8 months from the day you send the application. You can check on visajourney.com on the link K1 visa all the processing times for each service center (US immigration) and the average time it takes for each country. I know from the website somebody from Ukraine (and you can contact him looking under Ukrain users) and he took him 7 months and now his happily married.
Do not hire a lawyer for the visa, the forms you have to complete are very simple, just make sure you send everything and most important the evidence that you met in the last two years (photos, boarding pass ecc ecc.)
The website visajourney.com became my bible, you can find all the instructions and support needed.
Good luck with everything. |
