Just got engaged (woot!) and I've been looking into what my korean fiance has to do about visas over the next few years. First theres the student renewal, then theres a whole shazam of 1 year alphabet soup visas she has to get each and every year.
If we just say to heck with it and get legally married, how long will it take to get the green card stuff all out of the way?

It definitely does vary from place to place. Check out uscis.gov for more information and downloadable forms. Plus, while you're in the forms section read the instruction sheet for the I-485. lots of important stuff for you to know there. If you do marry and file, be sure to file all the various forms together, even though it ain't cheap. Otherwise, things tend to go astray and it takes even longer to get it all done. She can continue to go to school though, even if you do marry and file all the paperwork. |

Is she already in US and you are US Citizen?
Then you get married and file I-130, I-864 (you file), I-485, I-131, I-765, I-693, (she files) and G-352a from both for you, . It will take from 8 months to 18 months to get interview for green card.

At least 2 years from the time of application, can be longer, depending on how backed up your district is. You also have to prove that it's a legitimate marriage and not immigration fraud. |
