I'm on H1status (not a visa since i changed my status while in the US), recently gotten married, my husband (US Citizen) is filing for petition, should i also file for EAD & Travel document? My H1 is expiring on 09/30/09.

You should file an application for adjustment of status (Form I-485)
concurrently with the visa petition. You can file an employment
application (Form 765)at the same time but you can also continue your H-1 employment if you want while the residence papers are in
process without other employment authorization. Since it may take more time to complete the process than when you H-1 expires,
filing the I-765 might be wise. You should not depart the US while
your applications are pending.There would be no need to apply
for a travel document unless it becomes necessary for you to
travel before obtaining your resident card. The form for that purpose
is I-131. |

Yes. You should definitely apply for the EAD.
I do not recommend Advanced Parole. The green process itself nowadays is very fast. I got mine within 6 months which included delays for 2 separate USCIS queries.

If you're currently undergoing the paperwork for adjustment of status, it is free to apply for an EAD. You can submit these papers together. I'm not sure if your H-1 status becomes null once you've applied for adjustment of status for permanent residency so you might as well go for the EAD paperwork also. |
