I am very in love with my fiancee we've been together for almost 6 years, he's a US citizen and i met him when i came to this country as an exchange student, when the program was over i went back to my country attended college for a year in a half and then decided we wanted to be together, i moved to the US to go to college with him ,after i graduated i got OPT worked here for a year and my OPT expired in December of 2008. I went back to my country and i came to the US February 14th 2009 to attend my best friend's wedding, my boyfriend proposed to me!!!...and we want to get married, can i get married if i entered the country with a tourist visa? and file for the petition and residency? I have always been here legally, i don't have criminal background here or in my country and i didn't come to the US with the intention to get married.
Would i have to go back to my country and file for the fiancee visa or can we just get married and apply for all these forms.
- Get married
- Once married and i have the marriage certificate in hand my husband files the following forms:
* I-130
* G-235A
* I-864
- I file the following forms:
* I-485
* I-765
* I-131
* G-325A
and Send all in one envelope?

The Fiance visa takes forever. Up to a year.. Especially in Latin countries. Get married. Then adjust your status. Call ICE and they will tell you all the documents you need. It takes about 4 months.. More or less.
Yes SEND it all in one envelope. Your work permission will come sooner and it lowers the cost of certain documents. |

I-693 needs to be included also. You must present the evidence of that you didn't come to US to get married on tourist visa to get green card approved.

The best thing to do is to go home and have your fiance apply for a fiance visa for you. Once it is approved, you can enter the US and have 90 days to marry and apply for your spousal visa. You can probably remain in the US while it is processed. If you marry while on a tourist visa, you can trigger a marriage fraud investigation (a tourist visa is not for getting married!), and may be required to return home while your spousal visa is processed -- and it can take 2 or 3 times longer to get a spousal visa than getting a fiance visa.
If you go home and your fiance gets you the fiance visa, you know you are following proper procedure and things should go much faster, cheaper & simpler than taking unnecessary risks. |

Do not send the I-130/I-485 and do not get married until about after May 14th to avoid the presumption of dual intent, which means visa fraud. Please speak to an AILA immigration attorney or you may seriously jeopardize your case. |
