I am a full-time mom and would like to sponsor my parents to immigrate to the US. How can I do it?

I am applying for my citizenship at the end of this month. Hopefully, by early next year, if everything goes well, I will be a naturalized citizen.

I would like to sponsor my parents to come to the US to immigrate. To petition them, I understand that I have to make an Affidavit of Financial Support. MY PROBLEM is: I don't work. I am a full-time mom with 1 baby and only my husband works. He makes close to 6 digits a year and supports me, my son, and partially his 4 other kids from previous marriage. He does not have a problem supporting my parents when they come over but I don't know if he will be legal to send his Affidavit of Financial Support for his in-laws.
HELP PLEASE!

When my parents come, they have big plans to work and support themselves too. They will probably realistically live with us for a couple months until they have gotten their paperwork in order (working permit, adjust status) then they would be able to work, get their own place, and live their own lives.

I understand that my husband's income should be good enough as my income since it could be labeled to as "household income." But the Affidavit (form) only asks about my personal income and not my husbands' or household income.

It really isn't much of a problem, you just aren't familiary enough with the forms. first of all, you need to file the I-130 immigrant petitions for your parents as those will take up to a year to process and approve for interview. Even though you don't have any personal income, your husband's income certainly does count, as long as he's willing to sign the affidavit of support as well as an eligible household member. he'd have to anyway to accept your I-864, as I imagine you are filing jointly even if you don't have a job. put your household income down as your income. Isn't that the case in reality at home?

Your husband can petition the visa for them and also sponsor them ! Or you can be the petitioner and he can be the sponsor , it works either way .He will need proof of income , tax return for second and third most recent tax year. You must show that your household income is equal to or higher than 125 percent of the U.S. poverty level for your household size. You must also include in your household size any immigrants you have previously sponsored ! If he makes close to 6 digits a year it shouldn't be a problem ! Check www.uscis.com you'll find all the answers !
Good luck to you and your family !

Ok, well, to answer your question, your husbands income is considered your income as well, so yes, you can be their sponsor. HOWEVER, do you really feel comfortable knowing that your husband will be fully responsible for all four of you, yet still only is partially financially responsible for his children from his previous marriage? Sounds like the breeding ground for resentment on his childrens part...if I were you, I'd try to get a job. The mother of your husbands other children most likely has to work, right? Since your husband is only partially responsible for them, as you say. This way, you are contributing, and the kids wont feel so unwanted.

Your family income has to be above 125% above the poverty line. That would include all members of your family plus your parents.
Your husband's six figure income is more than emough to sponsor your parents.

But the Affidavit (form) only asks about my personal income and not my husbands' or household income.

Everywhere I read says HOUSEHOLD income is allowed, so write down household income. (See links below)

It doesnt matter if the parents plan to work. The point is that you will be responsible for all their financial requirements whenever they are NOT working for the first 10 years after they arrive. If they are able to work, then you will be fine as they can support themselves.

BUT in this depressed economy if they cannot find jobs or should LOSE their jobs, they cannot go on welfare - you must support them.

f you are a U.S. citizen and at least 21 years old, you are eligible to petition to bring your parents to live and work permanently in the United States. As the sponsor of your parents, you must show that your household income is sufficient to support your family and your parents at 125% or more above the U.S. poverty level for your household size.

It does say HOUSEHOLD income - so you may be lucky.

Anyone can be a sponsor, if they have the money.

This point is only so they won't be a public charge.

You husband's income should be OK for this. However, I suggest that since money does not appear to be a problem that you consult an immigration lawyer first to make sure.
